Rachel Bilson Protects Her New Clothing Line



Rachel Bilson used to be known as the “other” girl on The O.C.  However, in recent years, she has appeared in several films (most recently Jumper) and has become even more popular for her fashion choices.   That’s probably the reason why DKNY signed a deal with Rachel to design a junior sportswear line called EDIE ROSE.  Bilson reportedly did not want her own name on the label, but named the line after her grandmother (Edie) and a close family friend (Rose).  The line, to be sold in Macy’s, Lord & Taylor and Nordstrom, is mostly black and white with some yellow (after a yellow scarf which inspired Rachel).  

Now for some of the most important questions (from a trademark point of view): was a trademark application filed and who owns it?  The EDIE ROSE Application Serial No. 77/362,536 was filed for use on “tops; jeans; dresses; shirts; jackets; sweaters; caps; pants” in Class 25.  The application was filed on January 2, 2008 on behalf of Rachel Bilson.   The application was published for opposition on June 10, 2008, and a Notice of Allowance recently issued on September 2, 2008.  Once a Statement of Use is submitted in which a specimen (such as a hangtag or clothing label) and the dates of first use are submitted, the application will then proceed towards registration.

While Rachel does not yet appear to own a RACHEL BILSON trademark application (and appears reluctant to put her own name on a label), many fans look forward to seeing her line in the stores and hope that she will continue with EDIE ROSE and her own branding efforts.
